Terms of Use

1.1. SIA DM grupa (hereinafter – "DM grupa" or "Seller") offers physical products (fiberglass hot tub shells, cellars, spa equipment, accessories) and related services displayed in the online store at www.dmgrupa.lv (hereinafter – "E-store").

1.2. When a buyer places an order in the E-store, a Distance Sale Agreement is entered into between DM grupa and the buyer. Rights and obligations arising from consumer protection laws apply to buyers who are natural persons acquiring goods for purposes outside their trade, business, or profession (Consumers).

1.3. By placing an order, the Buyer confirms that they are at least 18 years of age and legally capable. If the Buyer acts on behalf of a legal entity, they confirm they have full authority to represent that entity.

1.4. Ownership of the purchased goods transfers to the Buyer on the date when both conditions are fulfilled: the goods have been delivered and full payment has been received by DM grupa.

2.1. All product prices in the E-store are displayed in Euros (€) including statutory Value Added Tax (VAT 21%).

2.2. Product prices do not include delivery costs unless explicitly stated otherwise. Delivery fees depend on the product dimensions, weight, and delivery destination, and are calculated during checkout or agreed upon individually for large freight items.

2.3. Payments can be made via:

• Payment card or secure internet banking integration;
• Advance bank transfer based on an invoice issued by DM grupa.

2.4. Payment is considered complete on the day funds are fully credited to DM grupa’s bank account.

3.1. To place an order, the Buyer selects the products, configuration, and options in the E-store, provides accurate shipping and billing details, and confirms the order.

3.2. Upon receiving the order, DM grupa sends an automated order confirmation to the email address provided by the Buyer.

3.3. Production and preparation time: For items in stock, dispatch takes 2–5 business days. For customized products (such as hot tub shells or custom color specifications), manufacturing typically takes 7–14 business days.

3.4. Delivery: Physical delivery is carried out using dedicated courier/freight transport or pickup as agreed. The carrier or DM grupa contacts the Buyer prior to delivery to arrange the date and time.

3.5. Inspection upon delivery: Upon receiving the physical goods, the Buyer is obliged to inspect the external packaging and product condition in the presence of the courier. In case of visual damage, a damage report must be drafted immediately with the delivery driver.

4.1. DM grupa guarantees that the sold products comply with manufacturer quality standards and specifications.

4.2. In accordance with EU and Latvian consumer rights legislation, physical goods are covered by a 2-year statutory warranty for consumers from the date of handover.

4.3. The Buyer is obliged to read and adhere to the installation, operation, and maintenance manuals provided with the products.

5.1. A consumer has the right to withdraw from the Distance Agreement within 14 (fourteen) calendar days from the day the goods were received, without stating any reason.

5.2. To exercise the right of withdrawal, the consumer must notify DM grupa in writing before the 14-day period expires by sending a notice to info@dmgrupa.lv.

5.3. Exceptions: In accordance with Cabinet of Ministers Regulation No. 255, the right of withdrawal does not apply if goods are made to the consumer's individual specifications or are clearly personalized (e.g. customized dimensions, non-standard fiberglass color mixes, custom drilled holes or modifications).

5.4. The consumer is responsible for returning the goods within 14 days of submitting the withdrawal notice. The direct cost of returning physical goods is borne by the consumer.

5.5. DM grupa refunds all payments received from the consumer (excluding additional costs resulting from choosing a non-standard delivery type) within 14 days after receiving the returned goods or proof of dispatch.

6.1. Personal data provided during the ordering process is processed exclusively for order fulfillment, delivery, invoicing, warranty maintenance, and compliance with statutory obligations.

7.1. Any complaints or disputes shall be settled through mutual negotiations. Please submit your inquiry to info@dmgrupa.lv, and DM grupa will reply within 15 days.

7.2. If a dispute cannot be resolved through negotiations, consumers may apply to the Consumer Rights Protection Centre of Latvia (PTAC, www.ptac.gov.lv) or use the EU Online Dispute Resolution platform (ec.europa.eu/consumers/odr).

7.3. DM grupa reserves the right to amend these Terms. Orders placed prior to any amendments are governed by the Terms in force at the time the order was confirmed.
